Iowa kidnapper denied post-conviction relief

MASON CITY, Iowa (AP) — A Mason City man serving 25 years in prison for kidnapping has had his motion for post-conviction relief denied.

The Mason City Globe Gazette reports (http://bit.ly/16zjiSY) that 59-year-old Michael Jon Winters’ latest motion was died Friday in Cerro Gordo County District Court.

Winters pleaded guilty in early 2011 to using a rifle in forcing a woman from her home in Mason City and taking her to a home in Rockford in 2010. She was released later in the day.

Before Winters’ sentencing, a judge denied his motion to withdraw the plea, which Winters had negotiated as part of a plea agreement.

In his latest motion, Winters argued that his attorney was ineffective because she should not have permitted him to plead guilty, and that the plea was not voluntary.
