Iowa court reinstates lawsuit over use of Tasers

IOWA CITY, Iowa (AP) — The Iowa Supreme Court has reinstated a lawsuit that claims police officers improperly used Tasers on a man during a fight at a concert in North Liberty in 2007.

The court ruled Friday that local police are not immune from lawsuits under a law that generally shields state officers from liability for official acts taken to enforce state laws.

The ruling overturns a district judge who had dismissed the lawsuit filed by Joshua N. Thomas against several North Liberty police officers and Johnson County deputies.

Thomas contends that he was wrongfully assaulted and arrested by officers when he tried to break up a fight at a concert at North Liberty Fun Days. He claims that several officers unnecessarily used Tasers on him, which has caused ongoing pain and muscle damage.
