According to an order issued Monday afternoon by Judge James Drew, the charges against Chad Lutcavish have been dismissed.
NORTHWOOD, Iowa – It’s usually the defense team that files a motion to dismiss a case, but this time a north Iowa man facing serious charges may be having his case tossed out by the prosecution.
35-year-old Chad Lutcavish is charged with first degree kidnapping in an incident involving another adult in rural Manly last October. His trial is set to begin on May 14, but if prosecutors have their way, the case will be dismissed altogether. According to a court filing by the Assistant Iowa Attorney General Scott Brown, there is not enough evidence to support the charge, and that Lutcavish should be released “in the interest of justice.”
Brown says the state plans to keep the investigation open and may bring new charges if enough evidence comes to light.
