KIMT News 3 – A Cerro Gordo County man who pled guilty but got a stiffer sentence than he expected has lost his case in the Iowa Court of Appeals.
In July of 2013, 26 year old Aaron Michael Hermen pled guilty to domestic abuse assault by strangulation, OWI third offense and child endangerment. As part of a plea deal, the prosecutor agreed to recommend a sentence of only 60 days behind bars on all charges.
The judge instead sentenced Hermen to 5 years in prison, which was the suggestion of a presentence investigation report. Hermen appealed, contending his attorney was ineffective and the judge abused his discretion by ignoring the plea deal and citing Hermen’s long history of criminal convictions in doing so.
The Iowa Court of Appeals has rejected those arguments and affirmed Hermen’s 5 year sentence.
