Assault and harassment convictions overturned

KIMT – The Iowa Court of Appeals has reversed the convictions of a Cerro Gordo County man and remanded the case for retrial.  54 year old Robert Lee Gomez of Mason City was found guilty of assault resulting in bodily injury and 2nd degree harassment for two alleged incidents in May of 2012.  Gomez was accused of punching another man in the face during the band festival parade in Mason City and then threatening the same man the next day.  Gomez appealed his convictions, claiming his attorney did not challenge incomplete and unclear instructions to the jury.  The Court of Appeals agreed with Gomez’ arguments.  Gomez had been ordered to spend 45 days behind bars and pay a 315 dollar fine.
