DES MOINES, Iowa – A Cerro Gordo County man who got more of a prison sentence than he bargained for will not get his case heard by the Iowa Supreme Court.
26-year-old Aaron Michael Hermen pled guilty in 2013 to domestic abuse by strangulation, OWI third offense and child endangerment. As part of a plea agreement, the prosecutor recommended a sentence of only 60 days behind bars. The judge ignored that, and sentenced Hermen to five years in prison, which was the suggestion of the pre-sentence investigation.
Hermen appealed that ruling, arguing his attorney was ineffective and there was an abuse of judicial discretion. The Iowa Court of Appeals rejected those claims and the Iowa Supreme Court has now declined to review Hermen’s case
