CHARLES CITY, Iowa – A hearing date has been set on the sentence given a former band teacher who sexually abused a 15-year-old girl in Floyd County.
In April, 33-year-old Benjamin Thompson received a 10 year suspended prison sentence and five years of probation after pleading guilty to one count of 3rd degree sexual abuse. He also received probation after pleading guilty to sexual abuse charges in Marion County.
In September, however, Floyd County Attorney Rachel Ginbey filed a motion to correct an illegal sentence in Thompson’s case. She says as a teacher, Thompson was classified as a mandatory reporter under Iowa law and such individuals are not eligible to receive suspended sentences in cases of child abuse where the victim was under 18.
A hearing on Ginbey’s motion is now scheduled for December 13.
